TERMS & CONDITIONS
Definitions
- “You” / “Client” – The individual(s) in whose name or on whose behalf the booking is made.
- “We” / “Us” / “Company” – Divine Yatras OPC Pvt Ltd.
- “Independent Contractors” – Hotels, airlines, shipping companies, coaches, or other service providers selected by the Company.
- “Tour Cost” – The amount specified in the Total Tour Cost column of the Booking Form.
Payment & Foreign Exchange (FX) Component
- Payments must be made using the cardholder’s own card, except for immediate family members traveling together.
- Initial INR deposit will be adjusted against the FX component.
- Rate of Exchange (ROE) for FX payments will be as per the prevailing rate on the final payment date.
Hotels
- Hotels are selected for comfort and convenience; some may be located away from city centers.
- Triple rooms may include rollaway beds; rooms typically accommodate up to three persons.
- Clients are responsible for personal belongings; use of hotel safes is at the client’s own risk.
- Early check-in or late check-out is subject to availability. Hotel facilities such as minibar, TV, and pay services are not included.
Airline & Baggage
- The Company is not responsible for airline delays, overbooking, lost baggage, or meals.
- Carry-on luggage: 1 bag + 1 personal item (max 7 kg / 115 cm linear).
- Checked baggage: Usually 20 kg; may vary by airline.
- Extra baggage charges must be paid directly to the airline.
Tipping
- Tipping for guides, drivers, porters, etc., is customary unless stated otherwise. Your Tour Manager will guide you.
Itinerary Changes
- Itineraries may be amended due to maintenance, festivals, traffic, or operational reasons.
- Missed sightseeing due to client delays is non-refundable.
Loss / Damage
- The Company is not responsible for lost, stolen, or damaged baggage or personal items during the tour.
Coach & Seating
- Air-conditioned coaches are provided where applicable.
- No fixed seat allocation; daily seat rotation may occur.
- Clients are responsible for valuables left in the coach or vehicle.
Child Accommodation
- Children under 10 without a bed will not receive a separate hotel bed.
- Rooming changes during the tour may incur additional charges.
Single Occupancy
- Full tour cost is required for single occupancy.
- If no other single traveler is booked, an additional 35% of the tour cost applies.
Registration & Authorization
- Bookings made via a travel agent are considered authorized by the client.
- Signing the booking form constitutes acceptance of all Terms & Conditions.
Visa Rejection
- Visa issuance is at the sole discretion of the respective consulate.
- The Company only provides guidance and is not responsible for visa rejections or delays.
Tour Date Changes
- Requests to transfer to another tour date prior to departure will be treated as cancellations and subject to applicable charges.
Cancellation Policy
- Advance payments are non-refundable.
- Cancellation charges based on days prior to departure:
- 31–45 days: 50% refundable
- 22–30 days: 25% refundable
- Below 21 days: No refund
- Third-party bookings (airlines, cruises, etc.) may have separate cancellation rules.
Payments
- For International / Fixed Departure Tours: 50% of Tour Cost + GST at booking.
- Balance Payment: Full payment 60 days prior to departure.
- EMI / SANKASH / MEHURU schemes available; clients are responsible for bank repayments.
Refunds
- Refunds are processed directly or via travel agents within 30 working days (up to 90 days for third-party services).
- No refunds for unutilized services.
- FX refunds will be in INR at prevailing rates.
Deviations
- Travel outside published dates may incur additional charges.
- Requests must be submitted in writing and are subject to availability and applicable taxes.
Currency & Travellers Cheques
- Recommended: a mix of cash, travellers cheques, or travel currency card.
- Lost travellers cheques can be replaced with the counterfoil and cheque numbers.
Scope of Activity
- The Company acts as an agent; services are provided by independent contractors.
- The Company is not liable for injury, death, loss, or damage caused by contractors.
Privacy
- Client information is shared only with service providers.
- Information may be disclosed if required by law or government authorities.
Health & Insurance
- Clients must disclose medical conditions; certain tours may be unsuitable.
- Comprehensive travel/health insurance is mandatory; claims handled directly with the insurance company.
- Senior citizens require separate insurance arrangements.
Force Majeure
- The Company is not liable for delays or disruptions due to natural disasters, strikes, riots, wars, pandemics, or government actions.
- Additional costs arising due to force majeure will be borne by the client.
Children Charges
- Children 3–10 years: 90% of tour cost with a seat, no extra bed.
- Extra bed/seat: full tour cost.
- For two children with two adults: one child at 100%, one at 90%; one extra mattress provided.
Other Terms
- Prices are subject to change due to currency fluctuations, fuel costs, taxes, or seasonal surcharges.
- The Company is not liable for missed sightseeing, services, or additional expenses due to delays.
- Travel insurance is strongly recommended.
- All payments must be made through Divine Yatras OPC Pvt Ltd accounts; never to individuals.
Legal Jurisdiction
- All legal proceedings will be subject to the jurisdiction of Bangalore-Hubballi-Dharwad courts.
Mode of Payment
- 50% of the total cost must be paid at the time of booking.
- Full payment must be made 15 days prior to departure for Kailash Mansarovar Yatra.
Changes by You
- Any changes to your tour must be informed at least 30 days in advance.
- Extra charges or losses incurred due to changes will be borne by the client.
Travel Insurance
- Clients are strongly advised to purchase comprehensive travel insurance covering:
- Medical emergencies
- Natural calamities
- Helicopter evacuation
- Personal accident
- Trip cancellation
- Insurance is available through India-based companies; the Company does not provide its own policies.
Cancellation by the Company
- Tours may be canceled due to:
- Border closures
- Government permit issues
- War, riots, civil disturbances, or strikes
- Natural disasters, terrorist threats, or airport closures
- In such cases, clients will be offered either:
- An alternative trip of comparable standard, or
- Refund after deducting expenses already incurred (flights, visas, permits, hotels, vehicles)
- A detailed expense statement will be provided for insurance claims.
- The Company cannot be held liable for denied entry even with a permit if local authorities deem the client ineligible. Do not commence travel until permit confirmation is received.
